Agreement to Terms

These Terms of Service ("Terms") govern your use of BCZ Central's infrastructure services, including proxy services, content delivery network (CDN), cloud infrastructure, and search engine platforms (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms.

BCZ Central is operated by BizTransit Sdn Bhd, a company registered in Malaysia (Company No. 891234-X). If you don't agree to these Terms, please don't use our Services.

Account Registration

To use our Services, you must create an account. When registering, you agree to:

• Provide accurate, current, and complete information
• Maintain and update your information to keep it accurate
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 18 years old to create an account. If you're registering on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

Acceptable Use

You may use our Services only for lawful purposes and in accordance with these Terms. You agree not to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Transmit malware, viruses, or harmful code
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Services or servers
• Use the Services for illegal content distribution
• Launch DDoS attacks or other malicious activities
• Resell our Services without written authorization
• Use automated systems to scrape or extract data excessively

Service Availability

We strive to maintain 99.99% uptime as outlined in our SLA Agreement. However, we don't guarantee that the Services will be uninterrupted or error-free. We may need to suspend access for:

• Scheduled maintenance (with advance notice when possible)
• Emergency security patches
• Infrastructure upgrades
• Legal or regulatory compliance
• Suspected violations of these Terms

Fees and Payment

You agree to pay all fees associated with your use of the Services. Payment terms include:

• Billing Cycle: Monthly billing unless otherwise agreed
• Payment Method: Valid credit card or approved payment method required
• Auto-Renewal: Subscriptions renew automatically unless cancelled
• Late Payments: Overdue accounts may be suspended after 15 days
• Price Changes: We reserve the right to modify pricing with 30 days notice
• Refunds: Pro-rated refunds available within first 30 days of new service

Data and Content

Your Content

You retain all rights to content you upload, store, or transmit through our Services ("Your Content"). You grant us a limited license to host, store, and deliver Your Content solely for providing the Services.

Content Restrictions

You're responsible for Your Content and must have all necessary rights to use it. You may not upload or transmit content that:

• Violates intellectual property rights
• Contains malware or malicious code
• Violates privacy or data protection laws
• Is illegal, defamatory, or harmful
• Violates export control regulations

Data Security

We implement industry-standard security measures, but you're responsible for:

• Securing your own application code
• Managing access controls and permissions
• Maintaining backups of critical data
• Encrypting sensitive data before transmission

Intellectual Property

The Services, including all software, APIs, documentation, and infrastructure, are owned by BCZ Central and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or reverse engineer our software
• Remove proprietary notices from our materials
• Use our trademarks without written permission
• Create derivative works based on our Services

API Usage

When using our APIs, you must:

• Comply with rate limits and usage quotas
• Use API keys securely and don't share them
• Cache responses appropriately to reduce load
• Handle errors and implement proper retry logic
• Keep API libraries and SDKs updated

Third-Party Services

Our Services may integrate with third-party services. We're not responsible for third-party services, and your use of them is governed by their own terms and policies.

Termination

Either party may terminate this agreement:

• By You: Cancel anytime through your account dashboard
• By Us: We may suspend or terminate for violations of these Terms
• Effect of Termination: Access ends, data may be deleted after 90 days

We'll provide reasonable notice before termination unless immediate action is required for security or legal reasons.

Warranties and Disclaimers

THE SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We don't warrant that the Services will meet your specific requirements or that they'll be error-free or secure, though we work hard to achieve both.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BCZ CENTRAL AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:

• INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
• LOSS OF PROFITS, REVENUE, OR DATA
• BUSINESS INTERRUPTION
• LOSS OF GOODWILL OR REPUTATION

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold BCZ Central harmless from any claims, damages, or expenses (including legal fees) arising from:

• Your use of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your Content or its transmission

Compliance and Export

You must comply with all applicable laws, including:

• Data protection and privacy regulations (GDPR, etc.)
• Export control laws
• Anti-corruption and sanctions laws
• Industry-specific regulations (HIPAA, PCI-DSS, etc.)

Dispute Resolution

These Terms are governed by the laws of Malaysia. Any disputes will be resolved through:

• Good faith negotiation between parties
• Binding arbitration if negotiation fails
• Arbitration conducted in Kuala Lumpur, Malaysia

Changes to Terms

We may modify these Terms at any time. We'll notify you of material changes via email or service notifications at least 30 days before they take effect. Continued use of the Services after changes constitutes acceptance of the new Terms.

Miscellaneous

Entire Agreement

These Terms, together with our Privacy Policy and SLA Agreement, constitute the entire agreement between you and BCZ Central.

Assignment

You may not assign these Terms without our written consent. We may assign our rights and obligations to any successor or affiliate.

Severability

If any provision is found unenforceable, the remaining provisions continue in full force.

Waiver

Our failure to enforce any right doesn't waive that right.
